New Employer Obligation Took Effect October 1, 2013
The Affordable Care Act's requirement that employers notify their employees of the health coverage options available to them in the new Health Insurance Marketplace (Exchanges) went into effect on October 1, 2013. If you are an employer covered by the Fair Labor Standards Act (FLSA), this new obligation applies to you.
To help you understand what this requires of you, NAW has made available for your use a new Regulatory Alert, "Employer Health Coverage Notification Requirement Went Into Effect October 1, 2013." To view the Regulatory Alert, view the NAW Alert.
Administration Delays Full Implementation of Small Business Health Options Program Marketplaces
On September 26, the Obama Administration announced a one-month delay - to November 1, 2013 - in the date that the Small Business Health Options Program Marketplaces (a/k/a SHOP Exchanges) operated by the Federal Department of Health & Human Services (HHS) will be open for small employer enrollment. SHOP Marketplaces are open to employers with 50 or fewer full-time equivalent employees. HHS's press release on this topic is available here.
According to HHS, "The SHOP Marketplace for Federally-facilitated Marketplace states opened October 1, 2013, when small employers can start the application process and get an overview of available plans and premiums in their area. All functions for SHOP will be available in November and if employers and employees are enrolled by December 15, 2013, coverage will begin January 1, 2014."
